Leaseholders, tenants and visitors can all be injured by the condition of residential property (houses and flats). When considering a landlord’s liability for such an injury, unusual rules apply, which need careful consideration by PI lawyers.

This course will:

  • provide participants with a knowledge and understanding of the law relating to a landlord’s liability for injury to occupants of and visitors to residential premises

  • enable participants to identify the possible claims which might arise e.g. injuries caused by housing disrepair, tripping on estate roads and common staircases, damp housing causing asthma, and allergic reactions to infestations

  • enable participants to understand where special or particular duties of care arise, what are the usual contractual liabilities of landlords and which statutory duties may give rise to civil liability

  • provide participants with a knowledge and understanding of the practical issues relating to such claims, including identifying the landlord, funding issues, use of the Disrepair Protocol (and its relationship with the PI protocol), the use of experts and limitation issues

  • provide participants with a knowledge and understanding of the Housing Health and Safety Rating System introduced by the Housing Act 2004, which introduces a new scheme for rating hazards in dwellings, and the duties which fall upon local authorities to take action, flowing from the identification of such hazards.

  • give participants an opportunity to practice what they have learned by use of worked examples/ case studies.

  • enable delegates to expand their civil litigation practices by taking on personal injury claims that have a clear housing law slant.
