David Withers

Joint Coordinator of APIL’s Brain Injury Special Interest Group, Irwin Mitchell, Sheffield

David is a partner leading two of our five Sheffield teams specialising in serious injury cases. David’s specialism is cases involving traumatic brain injury, spinal cord injury, amputations and very significant orthopaedic injuries. He has recovered over £140 million for his clients including recent settlements for £18M, £9.6M, £6.3M and £1M. He has been part of the legal team in over 25 cases which have resolved for more than £1M.

David has taken cases to trial at the High Court. He has also successfully succeeded on a seven figure claim at a liability trial in the High Court; the Defendant unsuccessfully sought leave to appeal to the Court of Appeal.  

David has been awarded Higher Rights of Audience (Civil). He has represented families at Court hearings and inquests. 

David has been independently ranked by Legal 500 with the most recent entry being:

In 2020, David was shortlisted for the National Catastrophic Injury Lawyer of the Year award.

David is the secretary for the Association of Personal Injury Lawyer’s (APIL) brain injury group. He arranges training and networking events for lawyers. In addition, he is accredited by APIL as a fellow and brain injury specialist. He assesses aspiring lawyers who wish to become brain injury accredited on behalf of APIL. He has delivered training for APIL to other lawyers.

David has had over 30 articles published in the Journal of Personal Injury Lawyers, PI Focus, and NR Times.

David provides technical guidance to the National Serious Injury Team as well as providing advice to all national personal injury teams on funding issues.

In 2020, he presented to 225 aspiring lawyers in conjunction with the University of Law and Legal Cheek as well as presenting to 150 fellow lawyers.
