CPD
6 hours
Target audience
Any level

Overview

This intensive one-day course is designed specifically for clinical negligence lawyers seeking a comprehensive update on the latest legal, procedural, and practical developments in this complex area of practice. The programme will explore recent reforms, key case law, and emerging trends shaping clinical negligence litigation, with a strong focus on how these changes impact day-to-day practice.

Through focused analysis of breach of duty, psychiatric injury, causation, quantum, and procedural issues, the course will equip delegates with the knowledge and practical insight needed to manage cases effectively and future-proof their practice.

Learning Objectives

By the end of this course, delegates will be able to:

  • Understand the latest reforms and current issues affecting clinical negligence practice and assess their implications for future case strategy
  • Analyse recent judgments on breach of duty and identify key themes relevant to advising and litigating claims
  • Evaluate the current legal position on psychiatric injury, including primary and secondary victim claims in clinical negligence
  • Apply up-to-date principles on causation, including “but for” tests, material contribution, and divisible and indivisible injuries
  • Identify current quantum issues and their impact on valuing clinical negligence claims
  • Navigate procedural challenges relating to issue and service, case and costs management, and expert evidence, avoiding common pitfalls
  • Distinguish between honest and dishonest claimants and understand the implications of findings of fundamental dishonesty
  • Address costs and funding challenges, including solicitor and own-client costs, Part 36 offers, and other current costs issues
