APIL research shows that victims of crime are being under-compensated by tens of thousands of pounds if they do not challenge the CICA’s decision-making.
Data obtained from the CICA shows a huge discrepancy between what is offered to victims before and after an appeal. In the 379 CICA cases which reached appeal in 2022/23, an average of £7,848 was initially offered. At an appeal, the CICA’s offer in these cases increased to £47,339 – six times more than their initial offer.
This demonstrates the vital importance of legal advice in these cases. Without such advice, victims are less likely to be able to challenge the CICA’s decision-making. For example, they are unlikely to know whether the initial offer they receive is fair, or have the skills, time, or confidence to challenge a decision.
