APIL damages series 2026 - Claims for Loss of Earnings of the Self-Employed and Those Involved in Entertainment & Sport

CPD
1 hour
Target audience
Any level

Overview

This webinar focuses on the unique challenges faced by self-employed individuals, business owners, and those working in sports and entertainment when claiming compensation for loss of earnings following an injury. With over 4.28 million self-employed people in the UK, these claimants often face difficulties in proving their income, future prospects, and losses. The session will explore practical issues such as undeclared income, limited company structures, and calculating net loss, as well as examining recent legal cases and outcomes. Attendees will gain insights into best practices for handling these claims effectively.

Objectives

By the end of the webinar, participants will be able to:

  • Understand the challenges faced by self-employed claimants, including directors of small companies, in proving loss of earnings.
  • Identify specific issues in claims involving sports and entertainment professionals, including establishing future earning potential and “loss of chance.”
  • Recognize practical difficulties arising from undeclared income and limited company structures.
  • Learn methods for calculating net loss accurately in various self-employed and business contexts.
  • Review recent case law to understand outcomes and precedents for self-employed and sports/entertainment claimants.
  • Apply best practices for preparing loss of earnings claims, including using specialized questionnaires designed for self-employed and business-owner claimants.
