CPD
1 hour
Target audience

Overview

Fatal accident litigation is fraught with procedural and evidential pitfalls. This webinar highlights the areas where cases most commonly go wrong and provides practical guidance on how to avoid costly mistakes.

Focusing on real-world scenarios and common errors, the session explores key challenges in limitation, procedural compliance, and evidential preparation, as well as examples of professional negligence claims arising from mishandled fatal accident cases. Participants will gain actionable insights to strengthen case management and reduce exposure to risk.

This webinar is essential for anyone involved in the conduct of fatal accident claims, from early-stage assessment to issuing proceedings.

Learning Objectives

By the end of this webinar, participants will be able to:

  • Understand limitation in fatal accident claims, including key deadlines and consequences of delay.
  • Identify matters that can bar or undermine a claim, such as statutory or procedural obstacles.
  • Navigate procedural issues when issuing proceedings, including correct steps and documentation.
  • Recognise common evidential weaknesses in fatal cases, and strategies to address them early.
  • Learn from professional negligence examples, understanding how errors in fatal accident litigation could have been avoided.

This session equips practitioners with practical tools to manage fatal accident cases efficiently while minimising procedural, evidential, and professional risks.
