Engagement on Mazur

In the last few weeks APIL has not rested as it presses for change and for clarity following the judgment in Mazur & Ors v Charles Russell Speechlys LLP.

Through many meetings with concerned members, we are acutely aware of the impact the decision has had on the sector, not least the human impact it has had on our legal executive members. It has been deeply distressing to see our highly skilled and devoted colleagues find that they cannot do the work to which they are committed and had been undertaking capably. Many are struggling with uncertainty over their jobs, years of work, commitment and sacrifice erased overnight. The uncertainty for the future and the position developing and changing on an almost daily basis continues to add to the worry.

Since day one we have engaged across the legal and regulatory sector to ensure that the voice of the PI profession is heard and understood. We immediately raised our concerns with the Legal Services Board (LSB). In an intensive programme of meetings with CILEX, the CILEX regulator (CRL) and the Solicitors Regulation Authority (SRA) we have highlighted the consequences for individuals at all levels, as well as the financial and operational impact on firms. We also met with colleagues at other sector organisations, including FOIL, ACSO, the Law Society, NHS Resolution, and MASS. Discussions and dialogue remain open.

As it stands the LSB is conducting a review following criticism of the messaging from CILEX on practising rights, but that review is not set to report until March. The LSB did confirm to APIL, though, that it is committed to ensuring that the frontline regulators work together to provide solutions. The SRA, disappointingly, would not commit to issuing further guidance due to concerns that it could overstep its remit. But it is still open to feedback from the sector, which APIL will continue to provide.

Meetings also continue between APIL and CILEX, which has now been granted permission to appeal the judgment in Mazur in relation to unauthorised fee-earners conducting litigation. It is a glimmer of progress but this action may not bring all the answers the sector needs, so the work to engage positively and press for clarity must continue.

While we cannot proffer our professional members all the answers immediately, I can guarantee that APIL continues to be at the forefront of discussions as the dedicated voice of the claimant PI sector.
