This intermediate-level course focuses on the legal framework, procedural requirements, and strategic considerations essential to litigating clinical negligence claims.
Objectives
By the end of the course, participants will be able to:
- Navigate key considerations in managing clinical negligence claims
- Obtain, interpret, and utilise medical records effectively
- Apply the Pre-Action Protocol strategically during the investigation and pursuit of claims
- Understand the legal principles surrounding breach of duty and causation
- Work effectively with medical experts, from initial instruction through to joint statements
- Handle case and cost management issues competently in clinical negligence litigation
- Recognise opportunities for alternative dispute resolution (ADR) and apply Part 36 offers effectively
- Stay informed on current developments and emerging issues in clinical negligence law
